    I am new here.

    I filed for SSDI in July of this year. I was taken out of work in June 2011 due to a work related accident. I am consisdered marked permantly disabled and will not be able to work. My Dr. advised me to apply for SSDI. I sent in what I though was a pretty complete application and I have been told by SSA that my Dr. medical records have all been faxed. I have always had depression, anxiety and Fibromyalgia. After initial treatment of these illnesses I rely on my PC to monitor and provide my medication. Since I mentioned these in my application I have been scheduled for two CE's for these related issues but not for the work related injury which is my primary problem at the current time. Can anyone give me any explanations for this? Do they need this to find me eligible or do they just need to make sure my medicals are complete? Any help will greatly reduce my anxiety!

    One explanation is that the DDS believes that the evidence is complete relating to the work-related injury and an allowance solely on that basis cannot be made. And so they are developing evidence of your other impairments.

    Incidentally, if your CEs are to be made by contract MDs rather than your own MDs and your claim is denied. Your 561 recon request should take them to task to explain why they believed your own MDs were not ready, willing, and able to do the CEs. This issue is often overlooked, and I can tell you that there were a no. of court decisions in the 80s that criticized SSA for not at least considering treating MDs to perform CEs. In fact, the court actions prompted a regulation in that regard that is often overlooked. - - Jack
