Can my ex employer cancel my COBRA 11-month extension?
I quit work due to disability in June. My COBRA qualifying event occured July 1. In August I applied for SSDI and listed my last date worked (in June) as my onset of disability date. In October I received my SSDI award letter, saying, "You are entitled to monthly disability benefits beginning December 2011." The only date in the letter was the date the letter was mailed in October. The letter did not specify my June onset of disability date.
I forwarded my SSDI award letter to my ex employer's COBRA plan administrator, who responded that I am not qualified for COBRA 11-month extension because the SSA disability determination was beyond 60 days after my COBRA qualifying event.
I feel this is unfair. Does the administrator have it right or wrong?
